HAWTHORN SUITES SUMMER SWEEPSTAKES

1. The Hawthorn Summer Sweepstakes (the "Promotion") starts on or about 12:01 am EDT on 08/01/2008 and ends at 11:59 pm EDT on 08/30/ 08 (the "Promotion Period"). Official rules also available at www.hawthorn.com.
2. Eligibility:
To enter the Promotion, you (the "Entrant") must be a lawful permanent resident of the United States age 21 years old or older. Employees, officers, directors, affiliates, successors and assigns of Hawthorn Suites Advertising and Reservations Fund, Inc. ("Sponsor"), Sponsor"s franchisees, and the advertising and promotion agencies of each (collectively, "Promotion Entities"), and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters, regardless of where they reside) and members of their households (whether related or not) are ineligible to participate in this Promotion. Sponsor respects the privacy of on-line visitors. To view Sponsor"s full online privacy policy please visit www.hawthorn.com. Any personal information collected will be used by Sponsor and its agent(s) solely to administer this Promotion and will not be used or disclosed for any other purpose without the consent of the applicable Entrant. By entering this Promotion, each Entrant agrees that the Promotion Entities have the right to contact Entrant by telephone, email or regular mail.
3. How to Enter the Promotion:
Go to www.hawthorn.com on or about 12:01 am EDT on 08/01/08, and before 08/30/08 at 11:59 pm EDT, and follow the on-screen instructions to complete the registration process. Limit of one entry per person and per email address per day. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all entries by that Entrant.
4. Instant Win Game:
Follow the on-screen instructions to enter the Instant Win Game. Each Entrant is given a chance to reveal three (3) symbols behind three (3) room doors on a virtual game piece. Entrants that successfully reveal three (3) matching Hawthorn Suites symbols are alerted on-screen and are eligible to win an Instant Win Prize as described below. Entrants that do not find three (3) matching Hawthorn Suites symbols and are not alerted and on-screen do not win.
Instant Win Game Prizes:
There will be a total of 109 random, pre-determined computer-generated winning times seeded over the course of the Promotion Period as indicated below. If your entry is the first one received on or just after one of those predetermined times, you will be eligible to win the specific prize designated to that time, subject to meeting the eligibility requirements provided herein, and will be notified immediately on screen. All entries are subject to verification, confirmation and compliance with these Official Rules. Odds of winning an Instant Win Game Prize will depend on the time your entry is received and the total number of eligible entries received. Please allow 6 to 8 weeks for delivery of prize.
The total value of Instant Win Prizes available to be won in this Promotion is estimated at $5,500 USD.
The prepaid gas cards awarded pursuant to this Promotion shall be subject to the terms and conditions of the card and the laws and regulations of the winner"s jurisdiction of residence. How to Claim Instant Win Prizes:
If you have been notified on screen that you are a winner, an Official Prize Claim Form will appear on the screen. To receive your prize, you must complete the Prize Claim Form and provide all of the information required and mail your fully completed and signed Prize Claim Form in a postage-paid envelope to: Hawthorn Suites Summer Sweepstakes Prize Claim, c/o Brandmovers, P.O. Box 723188, Atlanta, GA 31139 so that it is received by no later than September 30, 2008. Your Prize Claim Form will be void if all information required is not provided. Only Official Prize Claim Forms will be accepted. No duplicate Prize Claim Forms are allowed. Also, do not allow anyone else to use or copy your Prize Claim Form. In the event more than one Prize Claim Form is received for a specific prize award, then only the first Prize Claim Form received will be eligible for the prize. Any additional Prize Claim Forms received for the same prize award will be disqualified, as will any Prize Claim Forms that are deemed ineligible by Sponsor, in its sole discretion. You should retain a copy of each Prize Claim Form submitted. Sponsor will not confirm receipt of Prize Claim Forms. Sponsor assumes no responsibility for late, lost, misdirected, damaged, illegible, postage-due or incomplete Prize Claim Forms. All Prize Claim Forms must be completed by hand and are subject to verification by Sponsor or its designated agent, whose decisions are final and binding in all matters relating to this Promotion.
Sponsor reserves the right to refuse any entries deemed invalid or ineligible. If prize notification or attempted notification is returned as undeliverable, prize will be forfeited. Sponsor is not responsible for programming, coding, or other web production errors and Sponsor may rescind, cancel or revoke this Promotion based on any such error without liability at its sole discretion. If by reason of programming or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. Winners may be required to sign and return an Affidavit of Eligibility/Liability and Publicity Release (where legal) within the time period specified by Sponsor. In the event of non-compliance within this time, prize will be forfeited, except where prohibited. Prize Claim Forms become the exclusive property of Sponsor and will not be returned. By participating, Entrants agree to abide by and be bound by the Official Rules and all decisions of Sponsor and to waive any right to claim ambiguity in these Official Rules. All properly claimed prizes will be awarded and delivered to verified winners.
5. Grand Prize Sweepstakes:
All Entrants are automatically entered into the Grand Prize Sweepstakes upon completion of the registration process described in Section 3 and a random drawing from amongst all eligible entries received will be held on or about September 5, 2008. A Grand Prize ("Grand Prize") will be awarded to exactly one (1) Grand Prize winner ("Grand Prize Winner"). The odds of winning will depend on the total number of eligible entries received.
The Grand Prize package ("Grand Prize") consists of one (1) trip for four (4) persons to Orlando, Florida. Trip consists of round trip coach class air transportation to Orlando for the Grand Prize Winner and up to three guests, designated in writing, from a major U.S. airport closest to Grand Prize Winner"s residence that is served by Southwest Airlines with valid, scheduled service to Orlando (no substitutions are allowed); four nights hotel accommodations at the Hawthorn Suites Orlando/Lake Buena Vista, room and tax only, in one standard quadruple-occupancy room for up to four nights; full size rental car for up to five days; eight single-day (single park, where applicable) theme park admission tickets to Grand Prize Winner"s choice of Walt Disney World®, SeaWorld® Orlando or Universal Orlando®; and, one behind the scenes tour of Walt Disney World®, SeaWorld® Orlando or Universal Orlando® for up to four people;. (ARV of the Grand Prize: $4,801.00 USD). Travel must begin/end with the same major U.S. airport served by Southwest Airlines. Stopovers, open jaws, circle trips or frequent traveler mileages are not permitted. Once passengers are ticketed, any fee associated with flight changes or dates of travel is the responsibility of the winner. Tickets issued by Southwest Airlines will bear the date of issue and the date of expiration. Expiration dates will not be extended and tickets will not be refundable or redeemable for cash or credit at any time, nor will tickets be replaced if lost or stolen. Tickets valid on Southwest-operated, published, scheduled service only. Grand Prize Winner and his/her travel companions must travel together on the same itinerary. Winner will be solely responsible for ground transportation to/from the airport at point of origin. Final airport and hotel selection will be determined by the Orlando/Orange County Convention & Visitors Bureau, Inc. Rental car must have a driver who is at least twenty-five (25) years of age or order, have a valid drivers license and credit card (subject to terms and conditions of rental car company) and will be solely responsible for any additional costs associated with the use or possession of the rental car (i.e. supplemental insurance, gas, taxes). If winner does not meet rental car requisites/requirements, that portion of the prize will not be awarded and no additional compensation will be provided. Actual value may vary based on location and timing of departure. All other expenses not specifically identified in these Official Rules are the Grand Prize Winner"s responsibility, including local and ground transportation, meals, incidentals, tips, telephone calls or any other personal expenses incurred during the trip. All Grand Prize travel must be completed by August 31, 2009. All reservations are based on availability. Blackout dates or other restrictions may apply as dictated by airline and/or hotel.
This Grand Prize Package is non-transferable, has no cash value and cannot be extended or replaced if destroyed, lost, stolen or unredeemed. The travel companion(s) of the Grand Prize Winner must also sign a Liability and Publicity Release. If any travel companion of the Grand Prize Winner is deemed a minor in his/her state or jurisdiction of residence, then the parent/legal guardian of such minor must also sign any documents required herein and must accompany such minor on the trip. Any applicable taxes on any prize are solely the responsibility of the Grand Prize Winner. There are no cash alternatives to the Grand Prize. All travel arrangements must be made by Sponsor"s agent. Grand Prize Winner must arrange travel at least 60 days in advance. The Promotion Entities are not responsible if the Grand Prize, or any part thereof, cannot be awarded due to travel cancellations, delays or interruptions due to any acts of God, action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor"s sole control, and shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. The Promotion Entities will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to Entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize (including any travel or activity related thereto).
Grand Prize Winner Notification:
The potential Grand Prize Winner will be notified within fifteen (15) days after the selection of such potential winner by telephone, e-mail or mail. In order to receive the Grand Prize, the winning Entrant must complete and return to us an Affidavit of Eligibility and a Liabilities/Publicity Release Form, except where prohibited by law, within seven (7) days of receipt of notification as a potential Grand Prize Winner. Failure to return the signed Affidavit and Release within seven (7) days may result in forfeiture of the Grand Prize, except where prohibited by law. Awarding the Grand Prize is subject to verification, eligibility and compliance with these Official Rules. If a potential Grand Prize Winner cannot be contacted within seven (7) days of the first attempt to contact him/her, or if he/she fails to return the signed Affidavit and Release within seven (7) days, where legal, or if the potential Grand Prize Winner is deemed ineligible for any other reason in Sponsor"s sole discretion, the potential Grand Prize Winner will be disqualified. In the event of the disqualification of a Grand Prize Winner, an alternate Grand Prize Winner will be selected in his/her place by random drawing amongst all remaining eligible Promotion entries received.
The total value of all prizes available to be won in the Promotion is estimated at $7,301 USD.
6. General:
Entrants assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to Sponsor. Entrants agree to these Official Rules and to all decisions of Sponsor, or its designated agent, which are final and legally binding in all respects, and further agrees that all prizes are awarded upon the condition that the Promotion Entities or any of their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents shall have no liability whatsoever and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any prize, or participation in this Promotion or participation in any Promotion-related activities and further acknowledges that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its merchantability, quality, mechanical condition or fitness for a particular purpose. As a condition of entering, Entrants agree that (1) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorney"s fees. Sponsor reserves the right, in its sole discretion, without prior notice and at any time, to cancel, terminate or suspend this Promotion should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration or security of the Promotion (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming of the Instant Win Game). The Promotion Entities and their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents are not responsible for hardware, software or telephone failures of any kind, traffic congestion on the Internet or at any website or any combination thereof, lost network connections, incomplete, garbled or delayed computer transmissions, whether caused by Sponsor, users or by any of the equipment or programming associated with or utilized in the Promotion or by technical or human error which may occur and/or which may damage a user's system or limit a Entrant's ability to participate and/or redeem prizes in the Promotion. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Promotion, violates these Official Rules or otherwise engages in fraudulent or offensive conduct with respect to this Promotion. Caution: Any attempt to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent of the law. By accepting prizes, winners agree that Sponsor may use each winner's name, likeness, photograph and/or biographical information, without limitation, for promotional purposes without further consideration or payment, where permitted by law. All expenses not specified herein are the winners" responsibility. Taxes on and in connection with all prizes are winners sole responsibility; Sponsor or its designated agent may issue a Form 1099 to the winners for prizes with an ARV of $600 or more. Prizes are not transferable. No prize, cash or other substitutions allowed except at Sponsor"s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. Sponsor"s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect.
